Thank you for visiting Omnivere.com. Omnivere, LLC (“Omnivere” “we” or “us”) is committed to protecting your privacy. You can visit most pages on our site without giving us any information about yourself. Sometimes we do need information to provide services that you request, and this privacy statement explains data collection and use in those situations. Privacy Statement Regarding Website Visitors

The personal, private information you provide to Omnivere will be used to fulfill your information request.  Omnivere does not share any information about you or your company to unaffiliated third parties, except as necessary to respond to your information request or an explicit written agreement between all parties allowing the sharing of such information. Omnivere may share information collected during your Web-browsing process, including name and other personal information, among our affiliated companies to better serve your needs and notify you of services that might interest you, as permitted by applicable law. Omnivere does not share, distribute, sell or otherwise disseminate any information about you or your company, except as detailed above.

Collection of your Personal Information Via Our Website

We will ask you when we need information that personally identifies you (personal information) or allows us to contact you. This information can be used to identify you and includes but is not limited to, your first and last name, physical address, email address or other contact information. Generally, this information is requested when you are completing an information request form or accessing a secure section of the site. You can always choose not to provide personal information.

Use of Personal Information Collected on Our Website

We use your personal information for the following purposes:

  • To ensure our site is relevant to your needs;
  • To deliver services, such as newsletters, events or training that you request;
  • To help us create and publish content most relevant to you;
  • To alert you to product upgrades, special offers, updated information and other new services from Omnivere, if you so request; and
  • To allow you access to limited-entry areas of our site as appropriate.

We will merge site-visitation data with anonymous demographic information for research purposes, and we may use this information in aggregate to provide more relevant content. We occasionally hire other companies to provide limited services on our behalf, including packaging, mailing and delivering information, sending postal mail and processing event registration. We will only provide those companies the information they need to deliver the service, and they are prohibited from using that information for any other purpose.

Sharing of Personal Information

When you submit personal information, Omnivere does not share it with any third party except for the purposes of marketing automation and lead tracking. Our business partners are contractually obligated to

utilize the data only for the purposes of fulfilling services to Omnivere. If you would like your data removed from our systems, use the contact information at the bottom of this privacy policy to submit your request.

Cookies on Our Website

The purpose of this section is to explain how Omnivere protects and uses your personal information when using this site. We want you to know that information given to us is safe, secure and used in a responsible manner. We designed features of our site to let new visitors anonymously learn about our legal products and services without revealing their identities. For these new visitors, the only information we collect online is from cookies, pixel tags or similar devices, which provide limited data, such as the date, time and areas of our site that were visited, interactions on the site, and the Web path/domain where the visitor came from. Omnivere uses this information only to recognize you and hold information during your visit to the site. This general information allows us to serve visitors better by continually improving our website and making it more convenient.  In certain cases, you can choose not to provide us with the information, for example by setting your browser to refuse to accept cookies, but if you do you may be unable to access certain portions of the site. We may not be able to customize the site’s features according to your preferences.

At certain places on this site, live “links” to other Internet addresses can be accessed (“Linked Sites”). Such Linked Sites contain information created, published, maintained, or otherwise posted by institutions or organizations independent of Omnivere. Omnivere does not endorse, approve, certify or control these Linked Sites and does not guarantee the accuracy, completeness, efficacy, timeliness or correct sequencing of information that they contain. Omnivere’s Privacy Policy does not apply to these Linked Sites. The privacy policies of these Linked Sites may differ from Omnivere’s, and you should review their policies before accessing them and/or submitting information.

Privacy Statement Regarding Data We Receive from Clients

Omnivere is an eDiscovery services provider for clients. As such, Omnivere does not explicitly collect and store personal records of any individuals for providing these services. All information and data is collected from or on behalf of our clients. All data received from or on behalf of clients is used solely for the purposes defined in the contractual agreement of services between Omnivere and the client. No data is ever shared with any third party unless explicitly agree to in writing by our client. As such, it is important to note that all individual requests for correction, access, removal, or querying of data should first be directed towards the client and not Omnivere.

Security of Information We Collect

Omnivere takes the security of our client’s and website visitors data very seriously. We have put in place a number of technical, physical, and administrative security controls to ensure the ongoing confidentiality, availability, and integrity of all data entrusted to Omnivere. All security controls put in place at Omnivere are audited by an independent third party certification body as part of our ISO27001 certification. While we work to safeguard information we collect online, be aware that Internet security can be compromised.

Adherence to EU-US Privacy Shield

Omnivere complies with the EU-US Privacy Shield Framework as set forth by the US Department of Commerce regarding the collection, use, and retention of personal information from European Union member countries transferred to the United States pursuant to Privacy Shield.  Omnivere has certified that it adheres to the Privacy Shield Principles with respect to such data. If there is any conflict between the policies in this privacy policy and data subject rights under the Privacy Shield Principles, the Privacy Shield Principles shall govern. With respect to personal data received or transferred pursuant to the Privacy Shield Frameworks, Omnivere is subject to the regulatory enforcement powers of the U.S. Federal Trade Commission.

EU individuals have the right to obtain our confirmation of whether we maintain personal information relating to you.  Upon request, we will provide you with access to the personal information that we hold about you.  You may also may correct, amend, or delete the personal information we hold about you.  An individual who seeks access, or who seeks to correct, amend, or delete inaccurate data, should direct their query to Legal@omnivere.com.  If requested to remove data, we will respond within a reasonable timeframe.

Your right to access your personal data may be restricted in exceptional circumstances, including, but not limited to, when the burden or expense of providing this access would be disproportionate to the risks to your privacy in the case in question, or when the rights of persons other than you would be violated by the provision of such access.  If we determine that your access should be restricted in a particular instance, we will provide you with an explanation of our determination and respond to any inquiries you may have.

We will also provide an individual opt-out or opt-in choice before we share their data with third parties other than our agents, or before we use it for a purpose other than which it was originally collected or subsequently authorized.

In certain situations, we may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

Omnivere’s accountability for personal data that it receives under the Privacy Shield and subsequently transfers to a third party is described in the Privacy Shield Principles. In particular, Omnivere remains responsible and liable under the Privacy Shield Principles if third-party agents that it engages to process the personal data on its behalf do so in a manner inconsistent with the Principles, unless Omnivere proves that it is not responsible for the event giving rise to the damage.

In compliance with the EU-US, Omnivere commits to resolve complaints about your privacy and our collection or use of your personal information transferred to the United States pursuant to Privacy Shield. European Union individuals with Privacy Shield inquiries or complaints should first contact Omnivere using the contact information in the questions and contact section below.

Omnivere has further committed to refer unresolved privacy complaints under the Privacy Shield Principles to an independent dispute resolution mechanism, the BBB EU PRIVACY SHIELD, operated by the Council of Better Business Bureaus. If you do not receive timely acknowledgment of your complaint, or if your complaint is not satisfactorily addressed, please visit www.bbb.org/EU-privacy-shield/for-eu-consumers for more information and to file a complaint.
